Acceptable Use Policy

Last updated October 20, 2026 · Version 2

Last updated: 9 July 2026. This Acceptable Use Policy ("AUP") governs your use of TrustKard and forms part of our Terms & Conditions. It applies to everything you do on the platform, including the content of your digital cards, profiles, short links and QR codes, your use of lead capture and messaging, and your use of the store.

1. Purpose

This AUP sets out the conduct and content that are not permitted on the platform. It protects our users, the people who interact with cards and links, and the integrity of the Service. You are responsible for your own use of the Service and for the use by anyone acting under your account or within your company.

2. Prohibited Content

You must not create, publish, link to, or distribute through the Service any content that:

3. Prohibited Conduct

You must not:

4. Direct Marketing

If you use cards, links, contact forms or captured contact details to send electronic direct marketing (for example by email, SMS or automated message), you must comply with the direct-marketing rules in section 69 of POPIA and the Consumer Protection Act, 2008. You must not send unsolicited electronic communications for the purpose of direct marketing except to the extent the law allows (for example, with the recipient's consent or within an existing-customer relationship). Every marketing communication must identify you as the sender and provide a valid address to which the recipient can send a request to stop, and you must action opt-out and do-not-contact requests promptly. You must not use the Service to send, or to facilitate the sending of, direct marketing in a way that conceals the sender or evades these rules.

5. Security and Platform Abuse

You must not:

6. Content Standards and Responsibility

All content you publish must be accurate, lawful, and something you have the right to share. You are solely responsible for the content of your cards, profiles, links and messages, and for ensuring they comply with this AUP, applicable laws and any third-party terms (including those of wallet, payment and integration providers).

7. Enforcement and Consequences

We may investigate suspected violations of this AUP and, at our discretion and to the extent permitted by law, remove or disable offending content, deactivate cards, links or QR codes, apply rate limits, suspend or terminate accounts or companies, and report unlawful activity to the relevant authorities. Where reasonable, we will give notice before taking action, but we may act immediately where there is a risk of harm, legal exposure, or ongoing abuse.

8. Reporting Abuse and Notice-and-Take-Down

If you become aware of content or activity on the Service that violates this AUP, please report it to us using the support details published on our website. Please include enough information (such as the relevant link, card or page) for us to investigate.

Because we host content that our users publish, we also operate a formal notice-and-take-down procedure in line with Chapter XI of the Electronic Communications and Transactions Act, 2002 (ECTA). If you wish to have specific unlawful or infringing content removed or disabled, send a take-down notification in writing to our designated agent, using the take-down and abuse contact details published on our website. In terms of section 77 of ECTA, a valid take-down notification must include:

On receiving a notification that substantially meets these requirements, we will act to remove or disable access to the identified content within a reasonable time, without ourselves deciding the merits of the underlying dispute. We are not obliged to act on notifications that do not meet these requirements. Please note that, under section 77 of ECTA, a person who lodges a take-down notification containing a material misrepresentation may be liable for resulting damages; and, as permitted by ECTA, we incur no liability for acting in good faith on a notification we receive.

9. Intellectual-Property Complaints

We respect intellectual-property rights and require our users to do the same. If you believe that content published through the Service, such as a logo, trademark, image, text or other material appearing on a card, profile, link or review, infringes your copyright, trademark or other intellectual-property rights, you may submit a complaint using the notice-and-take-down procedure in section 8 above, identifying the right concerned and the material in question. We may remove or disable access to content that is the subject of a valid complaint, and may act against repeat infringers under the Enforcement and Consequences section above.
